define: Probate

Probate is required for decedents who owned real estate in their alone at the time of death, or if the decedent had more than $75,000 in personal property (i.e. cash, bank accounts, business interests) that do not have a designated beneficiary.

If the decedent did not have real property titled in their name and the value of their personal property is less than $75,000, Minnesota law allows for collection of personal property by affidavit.
